第一章 总则
第一条 为促进我校来华留学生(以下简称"留学生")教育的健康发展,规范留学生的行为举止,创造优良的学习、生活环境,根据《中华人民共和国出境入境管理法》、《学校招收和培养国际学生管理办法》(教育部、外交部、公安部令第42号)、《普通高等学校学生管理规定》、《南京林业大学学生违纪处理规定》以及其他相关规定,结合我校留学生的实际情况,制定本规定。
第二条 本规定适用于我校在籍学习的各类外国留学生。在校学习期间有违纪行为的,均按照本规定执行。
第三条 学校维护留学生合法权益,留学生在华学习期间,应遵守中国宪法、法律法规和学校各项规章制度,依法接受学校的管理,如有违法、违规、违纪行为,均按照本规定给予纪律处分,涉嫌违法犯罪的,依法移送司法机关处理。
第二章 纪律处分的种类与适用
第一条 对有违反法律法规、本规定以及学校纪律行为的留学生,应给予批评教育,并可视情节轻重,给予如下纪律处分:
(一)警告;
(二)严重警告;
(三)记过;
(四)留校察看;
(五)开除学籍。
第二条 违纪学生有下列情节之一,可以从轻或免予处分。
(一)能主动承认违纪事实,认识深刻,悔改表现突出的;
(二)能主动揭发他人违纪行为,经查证属实的;
(三)其他可从轻处分的情形。
第三条 违纪学生有下列情节之一,应从重处分。
(一)确有违纪行为,而拒不承认错误的;
(二)屡次违反学校规定受到纪律处分,经教育不改的;
(三)对检举揭发人、证人或工作人员威胁恐吓,打击报复的;
(四)其他应予以从重处分的情形。
第四条 受处分者,同时接受以下处理。
(一)对其处分情况将纳入本人奖学金评审及个人综合考核。
(二)受到记过以上处分者(含记过、留校察看、开除学籍),如有生活费补贴者视情节轻重停发三个月及以上生活费,并取消其所在学年奖学金及荣誉称号参评资格(举例:如某学生在2024年3月受记过处分,则取消其2023-2024学年奖学金参评资格),因公寓违纪受记过以上处分者,取消其宿舍居住资格。
(三)留校察看处分期限一般为一年,受到留校察看处分期间停发生活补贴,在奖学金年度评审时取消其奖学金及荣誉称号参评资格(举例同上);在此期间再次违纪的,给予开除学籍处分;解除察看期后再次违纪的,给予开除学籍处分。
(四)留学生未经批准擅自校外住宿,或因违反校内住宿规定而被取消校内住宿资格,将不予以发放校外住宿补贴或产生同等效应惩罚;留学生校外住宿期间违反法律法规及校纪校规,将被中止或取消其校外住宿补贴或产生同等效应惩罚。
(五)被开除学籍或勒令退学者,须在处分决定做出后10个工作日内办理离校手续。对逾期不办者,学校将告知公安机关出入境部门注销其居留许可,由此所产生的一切后果由其本人负责。
第三章 违纪行为及处理
第一条 违反中国法律、法令、法规,受到司法、公安部门处罚者,视不同情况给予以下处分:
(一)触犯《中华人民共和国刑法》,构成犯罪,被司法机关判处管制、拘役、有期徒刑及以上(含缓刑)刑罚者,给予开除学籍处分。
(二)违反《中华人民共和国治安管理处罚法》等法律、法规,被处以治安警告或治安罚款者,视情节轻重,给予严重警告至记过处分;被处以治安拘留、司法拘留者,视情节轻重,给予记过至留校察看处分,情节特别严重的,给予开除学籍处分。
(三)留学生应严格遵守《中华人民共和国传染病防治法》等相关法律和各地疫情防控相关规定,对于不遵守中国防疫相关法律和学校疫情防控规定者,视情节轻重,给予警告至留校察看处分;造成严重后果者,给予开除学籍处分。
(四)从事非法经营、非法就业等活动,视情节轻重,给予严重警告至开除学籍处分。
第二条 有下列影响中国社会稳定、妨害和扰乱社会秩序者,依法移送司法机关处理,并给予以下处分:
(一)对煽动、策划、组织非法集会、游行、示威、罢课等行为者给予留校察看或开除学籍处分;参与非法组织、集会、示威等活动的,视情节轻重,可给予记过以上处分。
(二)公开发表危害中国国家安全与统一的文章、演说、宣言、声明,经教育仍坚持不改者,给予开除学籍处分。
(三)窃取中国国家秘密者,给予开除学籍处分。
(四)煽动民族仇恨、民族歧视,或非法制作、复制、书写、印刷、张贴、散发有损安定团结的标语、传单、大小字报、图片等信息者,视情节轻重,给予留校察看或开除学籍处分。
(五)制造和故意散布谣言煽动他人,制造混乱者,视情节轻重,给予严重警告直至开除学籍处分。
第三条 组织、参加非法组织和活动者,依法移送司法机关处理,并给予以下处分:
(一)组织、成立、加入邪教、非法宗教、非法社会组织或社团,从事非法活动,出版非法刊物者,或利用某种活动或组织发展、控制成员,危害学校及社会正常秩序者,给予留校察看处分;情节严重的,给予开除学籍处分。
(二)组织、教唆、胁迫、诱骗、煽动他人从事各种反动、邪教、会道门活动或有参与、利用邪教、会道门、迷信活动扰乱社会秩序、损害他人身体健康者,给予留校察看处分,情节严重的,给予开除学籍处分。
(三)未经审批擅自组织募捐、收取活动经费、协会会费者,给予警告或严重警告处分;造成不良后果者,给予记过或留校察看处分。
(四)违反学校社团管理的有关规定,未经批准组织成立学生社团并开展活动,出版刊物并造成不良影响者,给予记过直至开除学籍处分;以合法学生社团的名义开展非法活动,损害学校声誉,造成不良影响者,给予留校察看或开除学籍处分。
第四条 违反信息网络安全管理有关规定,扰乱网络、通讯管理秩序者,涉嫌违法犯罪的,移送司法机关处理,尚未构成犯罪者,视情节轻重,给予以下处分:
(一)未经允许,侵入他人或公共计算机网络或使用计算机信息网络资源者,视情节轻重,给予严重警告直至开除学籍处分。
(二)蓄意更改、盗用公用或他人计算机网络信息资源、破坏计算机网络正常运行秩序者,视情节轻重,给予记过直至开除学籍处分。
(三)盗用或利用他人账号进行非法通讯,故意制作、传播计算机病毒等破坏性程序者,视情节轻重,给予留校察看或开除学籍处分。
(四)利用计算机网络从事危害中国国家安全、窃取中国国家秘密及违反校规校纪的活动,复制和传播有碍社会治安及违反社会公德的信息,视情节轻重,给予留校察看或开除学籍处分。
(五)有其他违反中国、学校网络管理规定、协议情形者,视其情节,给予相应处分。
第五条 违反学校规定,影响学校教育教学秩序、生活秩序以及公共管理秩序,涉嫌违法犯罪的,依法移送司法机关处理,尚未构成犯罪的,视情节轻重,给予以下处分:
(一)违反学校规定,侵害个人、组织合法权益,给予严重警告至留校察看处分;经教育后仍不改者,给予开除学籍处分。
(二)妨碍国家工作人员、学校管理人员依法或依据校纪校规执行公务的,给予记过或留校察看处分。
(三)有侵犯他人隐私及人身权利,视情节轻重给予严重警告、记过或留校察看处分;经教育后仍不改者,给予开除学籍处分。
(四)传播、复制、贩卖非法书刊和音像制品,组织参与非法 传销等非法经营活动,组织、策划和参与非法宗教、封建迷信活动 或邪教组织活动的,给予严重警告或记过处分。情节恶劣或者后果严重的,给予留校察看或开除学籍处分。
(五)在学校公共场合进行传教、宗教聚会等任何宗教活动,经劝阻、教育无效者,视情节轻重,给予警告至留校察看处分;情节特别严重的,给予开除学籍处分。
(六)在公寓、教室、图书馆等场所私拉电线或违章使用电器不听劝阻者,在公寓房间使用煤气炉、违章电器以及生火、燃烧物品者,视情节轻重,给予警告、严重警告或记过处分;造成火警报警、引发火灾事故者,给予留校察看或开除学籍处分。
(七)故意损毁、擅自挪用消防设施或各种安全、指示标志者,堵塞消防通道、无火情下触发报警装置、谎报火情者,阻碍消防车辆、人员通行者,扰乱火灾现场秩序者,在重点防火单位或场所擅自使用明火者,给予记过处分;情节严重的,给予留校察看处分;造成严重后果的,给予开除学籍处分。
(八)将枪支、弹药、管制刀具或者易燃、易爆、剧毒、放射性、腐蚀性物质或传染病病原体等危险品擅自带入学校或者带出实验室、仓库等规定保管场所,造成严重公共安全隐患者,给予留校察看处分;造成人身财产损失的,给予开除学籍处分。
(九)故意破坏学校公共财物者,视情节轻重,给予严重警告直至开除学籍处分,并对破坏物品进行相应赔偿。
(十一)严重扰乱教学楼、实验室食堂等公共场所秩序,且不听劝阻者,给予严重警告处分;情节严重的,给予记过直至开除学籍处分。
(十二)凡在学校公共场所或公寓、寝室等酗酒者给予严重警告处分,酒后滋事者,给予记过直至开除学籍处分。
(十三)有高空抛物、公共场所乱涂乱画、乱丢垃圾的,在公寓、教室、图书馆或其他禁止吸烟的地方吸烟,不听劝阻者,给予警告或严重警告处分。
(十四)在校园内违章驾驶、无证驾驶机动车、无校内通行证驾驶电动自行车者,或将电动自行车电源带入室内(公寓、办公室、实验室、教室等)充电者视其情节及后果,给予警告至留校察看处分。
(十五)将宠物带入教室、办公室、实验室、公寓等场所,不听劝阻者,给予警告或严重警告处分。
(十六)其他扰乱校园秩序、妨害校园安全文明的行为,给予警告或严重警告处分;情节严重的,给予记过直至开除学籍处分。
第六条 从事或参与有损留学生形象、有违中国社会公德活动者,涉嫌违法犯罪的,依法移送司法机关处理,尚未构成犯罪的,视情况轻重给予以下处分:
(一)观看黄色、淫秽音像制品、书刊、网页,或有其它色情行为者,给予警告直至留校察看处分;
(二)制作、复制、贩卖、传播淫秽等非法书刊、影片、音像、图片或其他淫秽物品、禁读作品者,视情节轻重,给予留校察看或开除学籍处分;
(三)在校园公共场所,行为不得体、不文明,经教育不改,或造成恶劣影响者,给予警告直至留校察看处分;
(四)有骚扰、调戏、侮辱女士或其他不雅行为者,视情节轻重给予记过直至开除学籍处分;
(五)介绍或参与"三陪"活动,视情节轻重,给予留校察看或开除学籍处分;
(六)嫖娼、卖淫或介绍、收容嫖娼、卖淫者,给予开除学籍处分;
(七)有污辱他人或对不尊重他人宗教信仰、风俗习惯等行为者,视情节轻重,给予严重警告及以上处分;
(八)其他违反社会公序良俗的情况,视情节轻重,给予严重警告直至开除学籍处分。
第七条 留学生在校期间,以任何形式参与赌博或变相赌博者,依法移送司法机关处理,并给予以下处分:
(一)提供赌博场所、赌资或赌具者,视情节轻重,给予警告、严重警告或记过处分;
(二)观看赌博者给予警告处分;
(三)组织赌博者给予记过或留校察看处分,一般参与者给予严重警告或记过处分,情节特别严重,影响恶劣者,给予开除学籍处分;
(四)多次参与赌博屡教不改者,给予留校察看或开除学籍处分;
(五)因赌博引起打架、斗殴或造成其他不良后果者,参照其他相应条款从重处分。
第八条 留学生引发和参与打架、斗殴的,相关处分办法参照《南京林业大学学生违纪处理规定(修订)》第十五条。
第九条 盗窃、诈骗、抢夺、侵占、敲诈勒索公私财物者,相关处分办法参照《南京林业大学学生违纪处理规定(修订)》第十四条。
第十条 学生有失信行为的,相关处分办法参照《南京林业大学学生违纪处理规定(修订)》第十七条。
第十一条 违反学校留学生住宿管理相关规定者,给予以下处分:
(一)未经批准,在公寓进行推销等商业活动,经教育不改者,给予警告直至留校察看处分。
(二)无故不按规定时间进出留学生公寓,不听劝告、不服管理者,给予警告直至记过处分;爬墙爬窗进出留学生公寓,给予严重警告或记过处分。
(三)未经允许擅闯留学生公寓,不听劝阻者,给予警告或严重警告处分。
(四)已登记为校内住宿却擅自离校住宿者,给予警告或严重警告处分,屡教不改者,给予记过或留校察看处分。
(五)在公寓内大声喧哗、打闹、拍球、大声播放音响等,严重影响他人休息、学习者,视情节轻重,给予警告直至记过处分。
(六)未经请假擅自夜不归宿者,视情节轻重,给予严重警告或记过处分。
(七)未经允许,容留非本寝室人员在留学生公寓住宿者,给予记过直至开除学籍处分。
(八)拖欠公寓住宿费,多次催缴无效者,通知其搬离宿舍(必要时相关部门协助)。
(九)对拒绝、阻碍学校管理人员依法、依规执行安全检查等公务者,给予警告或严重警告处分,情节严重者,给予记过直至留校察看处分。
(十)其他违反住宿管理规定的行为,视情节轻重及后果,给予相应处分。
第十二条 违反《高等学校学生行为准则》,对待教师、同学和工作人员态度恶劣者,视情节轻重和认识态度,给予警告、严重警告或记过处分。
第十三条 隐匿、毁弃、非法占有、私拆或以其他方式非法处理他人邮件者,给予警告直至留校察看处分。
第十四条 将他人遗忘物、保管物或埋藏物非法据为己有者,视情节轻重,给予警告直至留校察看处分;涉嫌违法犯罪的,依法移送司法机关处理,并给予开除学籍处分。
第十五条 走私、贩私者,视情节轻重,给予警告直至留校察看处分,涉嫌违法犯罪的,依法移送司法机关处理,并给予开除学籍处分。
第十六条 种植、制造、运输、买卖、吸食、注射毒品,或引诱、教唆、容留他人吸食、注射毒品者,给予开除学籍处分。
第十七条 投放有毒、有害物质,或以其他方式蓄意伤害他人身体者,给予留校察看处分;涉嫌违法犯罪的,依法移送司法机关处理,并给予开除学籍处分。
第十八条 留学生在一学期内旷课达到一定学时,相关处分办法参考《南京林业大学学生违纪处理规定(修订)》第十九、二十条。。
第十九条 学生不遵守考场纪律,不服从考试工作人员的安排与要求,相关处分办法参考《南京林业大学学生违纪处理规定(修订)》第二十一条。
第二十条 学生违背考试公平、公正原则,以不正当手段获得或者试图获得试题答案、考试成绩等行为的,相关处分办法参考《南京林业大学学生违纪处理规定(修订)》第二十二条。
第二十一条 学生在考场有严重作弊等行为的,相关处分办法参考《南京林业大学学生违纪处理规定(修订)》第二十三条。
第二十二条 违反学术规范行为者,给予以下处分:
(一)学位论文、公开发表的研究成果存在抄袭、篡改、伪造等学术不端行为,情节严重者,或者代写论文、买卖论文者,给予开除学籍处分。
(二)有剽窃、抄袭或者伪造研究成果、实验数据、计算结果等学术不端行为,未达到开除学籍处分程度者,视情节轻重,给予严重警告以上处分。
(三)伪造学术经历、学术成果、专家鉴定、证书及其他学术能力证明材料等行为,未达到开除学籍处分程度者,视情节轻重,给予严重警告以上处分。
第四章 处分和解除处分程序
第一条 对留学生给予纪律处分和解除处分,留学生所在学院和各有关单位要各司其职、协调工作,及时对留学生违纪事件进行调查并做出处理。
第二条 处分程序:
(一)相关单位、学院发现留学生涉嫌违纪或者接到有关情况报告后,及时进行调查取证,并联系国际教育学院(以下简称国教院),一同形成相关调查材料和处分材料;
(二)对留学生作出处分决定之前,应当告知学生作出决定的事实、理由及依据,并告知留学生享有陈述和申辩的权利,听取留学生的陈述和申辩;
(三)由留学生辅导员填写留学生处分登记表,写清留学生违纪事实;
(四)由留学生本人在处分事实上签字;
(五)国教院院务会议讨论应给予违纪留学生何种纪律处分;
(六)留学生受留校察看以下处分的,由国教院院务会议讨论通过签发处分决定书;开除学籍处分应当事先进行合法性审查,经校长办公会讨论通过后,由学校签发处分决定书,并报出入境部门;
(七)留学生纪律处分签发后,留学生纪律处分决定书应于5日内送达留学生本人,留学生拒绝签收的,可以以留置方式送达;已离校的,可以采取邮寄方式送达;难于联系的,可以利用学校网站、新闻媒体等公告方式送达,公告期为10日,自公告发布之日起算。
第三条 对留学生给予纪律处分,学校应当出具处分决定书。处分决定书应当包括下列内容:
(一)留学生的基本信息。
(二)作出处分的事实和证据。
(三)处分的种类、依据、期限。
(四)申诉的途径和期限。
(五)其他必要内容。
第四条 留学生如对处分结果有异议,在接到处分决定通知书10日内,可向国际教育学院提出申诉,留学生申诉按学校关于申诉的相关规定执行。
第五条 留学生被开除学籍的,应当自收到学校处分决定之日起10日内办理离校、居留许可注销及零次签证申请手续,并限于零次签证有效期限内离境;逾期不办理者,由国教院负责办理;拒不离校者,按校外人员扰乱学校秩序处理。
第六条 处分期限说明及解除处分程序:
除开除学籍处分以外,给予学生处分一般应当设置6到12 个月期限,处分期限自学校发文之日起计算。处分期限到期后,学生按程序申请解除处分。解除学生处分定期集中办理,解除处分日期按处分到期之日计算。
解除处分的程序:学生填写解除处分申请表,辅导员签署意见,国教院学生工作会议审议,国教院院务会议审核,报主管校领导决定,可以解除处分。
第七条 处分决定、解除处分决定自作出之日起生效。留学生的处分及解除处分材料,应真实完整地归入学校文书档案和本人档案。
第八条 解除处分后,留学生获得表彰、奖励、资助及其他权益,不再受原处分的影响。
第九条 学习期限内已受过处分者,若再次受到处分,处分等级累加。情节严重的,给予开除学籍处分。
第十条 对违反中国法律、法规受到司法机关处罚者的纪律处分,以司法机关的法律文书为依据。
第十一条 处分过程中及解除处分后,留学生辅导员要关注留学生情况,对留学生进行教育管理及谈心谈话帮扶,确保留学生对过往违规违纪行为有深刻认识并吸取教训,不致再犯。国教院对相关违规违纪行为学生建立档案,关注学生的发展情况。
第五章 附 则
第一条 本规定所指"以上"或"以下"处分,包含本级处分在内。
第二条 对本规定没有列举的违法、违规、违纪行为,可参照学校相关规章制度,视情节轻重及影响程度给予相应的处分。
第三条 本规定解释权归南京林业大学国际教育学院,由国际教育学院负责解释和补充,以中英文书就,若有歧义,以中文表述为准,本规定自颁布之日起施行。
Regulations on Handling Disciplinary Violations of International
Students of Nanjing Forestry University
Chapter 1 General Provisions
Article 1: In order to promote the healthy development of education for international students coming to China (here in after referred to as "international students") at our university, regulate their behaviors, and create a good learning and living environment, in accordance with the "Law of the People's Republic of China on the Administration of Exit and Entry", the "Management Measures for the Recruitment and Training of International Students in Schools" (No. 42 Order of the Ministry of Education, Ministry of Foreign Affairs, and Ministry of Public Security), and the "Regulations on the Administration of Students in Ordinary Higher Education Institutions", "Regulations on the Handling of Violations of Discipline by Students at Nanjing Forestry University" and other relevant regulations, the present regulations are formulated based on the actual situation of international students at our university.
Article 2: These regulations apply to all types of foreign students studying at our university. Those who violate discipline during their school studies shall comply with these regulations.
Article 3: The school shall safeguard the legitimate rights and interests of international students. During their study period in China, international students shall comply with the Chinese Constitution, laws and regulations, and various rules and regulations of the school, and accept the management of the school in accordance with the law. If there are any illegal, irregular, or disciplinary acts, disciplinary sanctions shall be imposed in accordance with these regulations. If they are suspected of illegal or criminal activities, they shall be transferred to judicial authorities for handling in accordance with the law.
Chapter 2 Types and Application of Disciplinary Actions
Article 1: International students who violate laws and regulations, the present provisions and school discipline shall be criticized and educated, and may be subject to the following disciplinary actions depending on the severity of the situation:
(1) Warning;
(2) Serious warning;
(3) Record a demerit;
(4) Stay on campus for observation;
(5) Dismissal from school.
Article 2: Students who violate discipline may be given a lighter or exempted punishment if they have one of the following circumstances.
(1) Those who can actively admit violations of discipline, have a profound understanding, and demonstrate outstanding repentance;
(2) Being able to proactively expose others' disciplinary violations, which have been verified to be true through investigation;
(3) Other situations where lenient punishment may be given.
Article 3: Students who violate discipline shall be given severe punishment if they have one of the following circumstances.
(1) Those who have indeed violated discipline and refuse to admit their mistakes;
(2) Repeatedly violating school regulations and receiving disciplinary action, but refusing to correct after education;
(3) Threatening or retaliating against whistleblowers, witnesses, or staff members;
(4) Other situations that should be given severe punishment.
Article 4: Those who are subject to punishment shall also be subject to the following punishments.
(1) The punishment will be included in my scholarship evaluation and personal comprehensive assessment.
(2) Those who have been punished with demerit recording or above(including demerit recording, stay on campus for observation, dismissal from school), if there is a living allowance, will be suspended for three months or more depending on the severity of the situation, and their scholarship and honorary title eligibility for their academic year will be cancelled (for example, if a student receives a punishment of recording a demerit in March 2024, they will be disqualified from participating in the 2023-2024 academic year scholarship evaluation). Students who receive a punishment of recording a demerit or above for violating apartment regulations will be disqualified from residing in the dormitory).
(3) The duration of the probation period is generally one year. During the probation period, the living allowance will be suspended, and their scholarship and honorary title eligibility will be cancelled during the annual evaluation of the scholarship(same as the example above); Those who violate discipline again during this probation period shall be subject to expulsion from school; Those who violate discipline again after lifting the probation period shall be expelled from school (4) International students who reside outside of campus without approval or are disqualified from campus accommodation due to violations of campus accommodation regulations will not be given off campus accommodation subsidies or punished with equivalent effects; International students who violate laws, regulations, and school rules during their off campus accommodation will be suspended or have their off campus accommodation subsidies cancelled or punished with equivalent effects.
(5) Those who are expelled from school or ordered to leave must complete the procedures for leaving school or China Within 10 working days after the disciplinary decision is made. For those who fail to comply with the deadline, the school will notify the public security organizations’ exit and entry department to cancel their residence permit, and all consequences arising from this will be the responsibility of the student herself/himself.
Chapter 3 Disciplinary Violations and Handling
Article 1: Those who violate Chinese laws, decrees, and regulations and are punished by judicial and public security departments shall be given the following punishments depending on the circumstances:
(1) Those who violate the Criminal Law of the People's Republic of China, constitute a crime, and are sentenced to public surveillance, detention, fixed-term imprisonment or above (including probation) by judicial authorities shall be subject to expulsion from school.
(2) Those who violate laws and regulations such as the Law of the People's Republic of China on Administrative Penalties for Public Security and are subject to public security warning or fine shall be given a serious warning to a demerit based on the severity of the situation; Those who are detained for public security or judicial purposes shall be subject to disciplinary action ranging from demerit recording to staying on campus for observation, depending on the severity of the circumstances. If the circumstances are particularly serious, they shall be subject to disciplinary action of being expelled from school.
(3) International students should strictly abide by relevant laws such as the "Law of the People's Republic of China on the Prevention and Control of Infectious Diseases" and local epidemic prevention and control regulations. For those who do not comply with Chinese epidemic prevention laws and school epidemic prevention and control regulations, depending on the severity of the situation, they will be given a warning to stay on campus for observation; Those who cause serious consequences shall be subject to expulsion from school.
(4) Engaging in illegal business operations, illegal employment, and other activities, depending on the severity of the situation, will be given a serious warning or expelled from school.
Article 2: Those who affect the stability of Chinese society, hinder or disrupt social order, shall be transferred to judicial organizations for handling in accordance with the law, and shall be given the following sanctions:
(1) Those who incite, plan, or organize illegal gatherings, marches, demonstrations, strikes, etc. shall be punished by staying on campus for observation or being expelled from school; Those who participate in illegal organizations, gatherings, demonstrations, and other activities may be punished with a demerit or more depending on the severity of the situation.
(2) Those who publicly publish articles, speeches, declarations, or statements that pose a threat to China's national security and unity, but cling to mistaken views or actions and refuse to correct after education, shall be expelled from school.
(3) Those who steal Chinese state secrets shall be punished with expulsion from school.
(4) Those who incite ethnic hatred or discrimination, or illegally make, copy, write, print, post, or distribute slogans, flyers, posters, pictures, or other information that is detrimental to stability and unity, depending on the severity of the situation, shall be punished by staying on campus for observation or being expelled from school.
(5) Those who create or intentionally spread rumors to incite others and create chaos shall be given a serious warning or even expelled depending on the severity of the situation.
Article 3: Those who organize or participate in illegal organizations and activities shall be transferred to judicial organs for processing in accordance with the law, and shall be given the following sanctions:
(1) Those who organize, establish, join cults, illegal religions, illegal social organizations or associations, engage in illegal activities, publish illegal publications, or use certain activities or organizations to develop and control members, endangering the normal order of the school and society, shall be punished by staying on campus for observation; If the circumstances are serious, the student will be expelled.
(2) Those who organize, instigate, coerce, deceive, incite others to engage in various reactionary, cult, or superstitious activities, or participate in or use cult or superstitious activities to disrupt social order or harm the physical health of others, shall be punished by staying on campus for observation. If the circumstances are serious, they shall be punished by being expelled from school.
(3) Those who organize fundraising, collect activity funds, or association dues without approval shall be given a warning or serious warning; Those who cause adverse consequences shall be punished with demerit recording or detention for observation.
(4) Those who violate the relevant regulations on the management of school clubs, organize and establish student clubs without approval, carry out activities, publish publications, and cause adverse effects shall be punished with demerits or even expelled from school; Those who engage in illegal activities in the name of a legitimate student association, damage the reputation of the school, and cause adverse effects shall be punished by staying on campus for observation or being expelled from the school.
Article 4: Those who violate the relevant regulations on information network security management, disrupt the order of network and communication management, and are suspected of committing illegal crimes, shall be transferred to judicial organs for handling. Those who have not yet constituted a crime shall be given the following punishments depending on the severity of the circumstances:
(1) Those who invade others’ and public computer networks or use computer information network resources without permission will be given a serious warning or even expelled depending on the severity of the situation.
(2) Those who intentionally alter or embezzle public or others' computer network information resources, or disrupt the normal operation order of computer networks, depending on the severity of the situation, shall be punished with demerits or even expulsion from school.
(3) Those who embezzle or use others' accounts for illegal communication, intentionally create or spread destructive programs such as computer viruses, depending on the severity of the situation, will be punished by staying on campus for observation or being expelled from school.
(4) Using computer networks to engage in activities that endanger China's national security, steal Chinese national secrets, and violate school rules and regulations, copying and disseminating information that hinders social security and violates social ethics, depending on the severity of the situation, will be subject to detention for observation or expulsion from school.
(5) If there are other violations of China's and school's network management regulations or agreements, corresponding punishment shall be given according to the circumstances.
Article 5: Those who violate school regulations, affect the order of education and teaching, daily life, and public management of the school, and are suspected of committing illegal crimes, shall be transferred to judicial organs for handling in accordance with the law. Those who have not yet constituted a crime shall be given the following punishments depending on the severity of the circumstances:
(1)Those who violate school regulations, infringe upon the legitimate rights and interests of individuals and organizations, be given a serious warning to stay on campus for observation; Those who refuse to change misbehaviors after education will be expelled from the school.
(2) Those who obstruct national staff or school administrators from performing their official duties in accordance with the law or school rules and regulations shall be punished with demerit recording or detention for observation.
(3) Those who violate the privacy and personal rights of others will be given serious warning, demerit recording, or detention for observation depending on the severity of the situation; Those who refuse to change misbehaviors after education will be expelled from the school.
(4) Those who spread, copy, or sell illegal books, magazines, audio and video products, organize and participate in illegal pyramid schemes and other illegal business activities, organize, plan, and participate in illegal religious, feudal superstition activities, or cult organization activities shall be given punishment of serious warning or demerit recording. If the circumstances are severe or the consequences are serious, the student will be subject to detention for observation or expulsion.
(5) Those who engage in any religious activities such as preaching or religious gatherings in public places of the school, and fail to be dissuaded, will be given warning or detention for observation depending on the severity of the situation; If the circumstances are particularly serious, the student will be expelled.
(6) Those who privately pull wires or illegally use electrical appliances in apartments, classrooms, libraries, and other places without listening to dissuasion, and those who use gas stoves, illegal electrical appliances, as well as lighting or burning items in apartment rooms, will be given warning, serious warning, or demerit based on the severity of the situation; Those who cause a fire alarm or fire accident shall be punished by staying on campus for observation or being expelled from school.
(7) Those who intentionally damage or misuse fire facilities or various safety and indicator signs, block fire passages, trigger alarm devices without fire, falsely report fire, obstruct the passage of fire vehicles and personnel, disrupt the order of the fire scene, and use open flames in key fire prevention units or places without authorization shall be punished with demerit recording; If the circumstances are serious, the offender shall be punished by staying on campus for observation; If serious consequences are caused, the student shall be expelled.
(8) Those who bring firearms, ammunition, controlled knives, or dangerous goods such as flammable, explosive, highly toxic, radioactive, corrosive substances, or infectious disease pathogens into schools or out of designated storage places such as laboratories and warehouses without authorization, causing serious public safety hazards, shall be given detention for observation; Those who cause personal and property losses shall be subject to expulsion from school.
(9) Those who intentionally damage the public property of the school will be given a serious warning or even expelled depending on the severity of the situation, and corresponding compensation will be given for the damaged items.
(11) Those who seriously disrupt the order of public places such as teaching buildings, laboratory canteens, without listening to the dissuasion will be given serious warning; If the circumstances are serious, a demerit will be recorded and the student will be expelled.
(12) Those who drink excessively in public places, apartments, dormitories, etc. of the school will be given a serious warning, and those who cause trouble after drinking will be given a demerit record or even expelled from the school.
(13) Those who throw objects from high altitude, scribble in public places, or litter, smoke in apartments, classrooms, libraries, or other places where smoking is prohibited, without listening to the dissuasion will be given warning or serious warning.
(14) Those who drive illegal, drive unlicensed motor vehicles or non- motorized vehicles, drive electric bicycles without a campus pass or bring the power supply of electric bicycles into indoor (apartments, offices, laboratories, classrooms, etc) for charging on campus will be given warning to stay on campus for observation depending on their circumstances and consequences.
(15)Those who bring pets into classrooms, offices, laboratories, apartments, and other places, without listening to the dissuasion will be given warning or serious warning.
(16) Any other behavior that disrupts campus order or hinders campus safety and civilization shall be given warning or serious warning punishment; If the circumstances are serious, a demerit will be recorded and the student will be expelled.
Article 6: Those who engage in or participate in activities that harm the image of students and violate Chinese social ethics, and are suspected of committing illegal or criminal acts, shall be transferred to judicial authorities for handling in accordance with the law. If the case has not yet constituted a crime, the following punishments shall be given depending on the severity of the situation:
(1) Watching pornographic or obscene audiovisual products, books, magazines, web pages, or engaging in other pornographic activities will result in a warning or even detention for observation;
(2) Those who produce, copy, sell, or disseminate illegal books, magazines, films, audiovisual materials, images, or other obscene materials, or prohibited works, depending on the severity of the circumstances, shall be punished by staying on campus for observation or being expelled from school;
(3) Those who behave inappropriately or uncivilized in public places on campus, and refuse to correct after education, or cause adverse effects will be given warning or even detained for observation;
(4) Those who harass, molest, insult lady or other indecent behavior will be punished with demerits or even expulsion based on the severity of the situation;
(5) Introduce or participate in the "Three Companions" activity, and depending on the severity of the situation, impose punishment of staying on campus for observation or being expelled from the school;
(6) Those who engage in prostitution, or introduce or accept prostitution shall be expelled from school;
(7) Those who insult others or do not respect their religious beliefs, customs and habits will be given a serious warning or above depending on the severity of the situation;
(8) For other violations of social order and good customs, depending on the severity of the situation, a serious warning or even expulsion from the school will be given.
Article 7: International students who participate in gambling or engage in disguised gambling in any form during their school years shall be transferred to judicial authorities for punishment in accordance with the law, and shall be given the following punishments:
(1) Those who provide gambling venues, gambling funds, or gambling equipment shall be given warning, serious warning, or demerit recording punishment depending on the severity of the situation;
(2) Those who watch gambling will be given a warning;
(3) Gamblers who organize gambling will be punished with demerit recording or school observation, while ordinary participants will be given serious warning or demerit recording. If the circumstances are particularly serious and the impact is severe, they will be expelled from school;
(4) Those who repeatedly participate in gambling and fail to correct after repeated education will be punished by staying on campus for observation or being expelled from school;
(5) Those who engage in fights, brawls, or other adverse consequences due to gambling shall be given a heavier punishment in accordance with other corresponding provisions.
Article 8: If international students start and engage in fights or brawls, the relevant disciplinary measures shall refer to Article 15 of the "Regulations on the Handling of Student Violations at Nanjing Forestry University (Revised)".
Article 9: For those who steal, defraud, seize, occupy, or extort public or private property, the relevant punishment measures shall refer to Article 14 of the "Regulations on the Handling of Student Violations at Nanjing Forestry University (Revised)".
Article 10: If a student commits dishonesty, the relevant punishment measures shall refer to Article 17 of the "Regulations on the Handling of Student Violations at Nanjing Forestry University (Revised)".
Article 11: Those who violate the relevant regulations on accommodation management for international students in the school shall be punished as follows:
(1) Those who engage in commercial activities such as sales promotion in an apartment without approval and refuse to correct after education will be given warning or even be detained for observation.
(2) Those who fail to enter or exit the international student apartment within the prescribed time without any reason, do not listen to advice, or do not obey the management will be given a warning or even a demerit recording punishment; Climbing walls and windows to enter and exit international student apartments will result in severe warning or demerit recording.
(3) Those who break into international student apartments without permission and do not listen to persuasion will be given warning or serious warning.
(4) Those who have registered for campus accommodation but leave the school without permission will be given warning or serious warning. Those who refuse to correct after repeated education will be given a demerit recording or stay on campus for observation.
(5) Those who Make loud noises, play games, rackets, or play audio loudly in the apartment, and seriously affect others' rest and learning, will be subject to warning or even demerit recording depending on the severity of the situation.
(6) Those who do not return home at night without asking for leave will be given a serious warning or demerit recording depending on the severity of the situation.
(7) Those who, without permission, allow non dormitory residents to stay in the international student apartment will be punished with demerits or even expulsion.
(8) If the apartment accommodation fee is overdue and multiple reminders are ineffective, the related students shall be notified to move out of the dormitory (with assistance from relevant departments if necessary).
(9) Those who refuse or obstruct school management personnel from carrying out safety inspections in accordance with the law and regulations will be given warning or serious warning. If the circumstances are serious, they will be given a demerit recording or even detention for observation.
(10) Other violations of accommodation management regulations shall be subject to corresponding punishment depending on the severity and consequences of the situation.
Article 12: Those who violate the "Code of Conduct for Students in Higher Education Institutions" and have a bad attitude towards teachers, classmates, and staff shall be given warning, serious warning, or demerit based on the severity of the situation and their repent attitude.
Article 13: Those who conceal, destroy, illegally occupy, privately open, or illegally process others' emails in any other way shall be given warning or even be detained for observation.
Article 14: Those who illegally take possession of forgotten, stored, or buried objects of others shall be given warning or even detention for observation depending on the severity of the situation; Those suspected of violating the law and committing crimes shall be transferred to judicial authorities for processing in accordance with the law, and shall be subject to expulsion from school.
Article 15: Smugglers and traffickers shall be given a warning or even detention for observation, depending on the severity of the situation. Those suspected of illegal or criminal activities shall be transferred to judicial authorities for processing in accordance with the law, and shall be subject to expulsion from school.
Article 16: Those who plant, manufacture, transport, trade, consume, or inject drugs, or lure, instigate, or tolerate others to consume or inject drugs, shall be subject to expulsion from school.
Article 17: Those who inject toxic or harmful substances, or intentionally harm others' bodies in other ways, shall be punished by staying on campus for observation; Those suspected of violating the law and committing crimes shall be transferred to judicial authorities for processing in accordance with the law, and shall be subject to expulsion from school.
Article 18: If international students are absent from class for a certain period of time within one semester, the relevant punishment measures shall refer to Article 19 and Article 20 of the "Regulations on the Handling of Student Violations at Nanjing Forestry University (Revised)".
Article 19: If students fail to comply with the discipline of the examination room or the arrangements and requirements of the examination staff, the relevant disciplinary measures shall refer to Article 21 of the "Regulations on the Handling of Student Violations at Nanjing Forestry University (Revised)".
Article 20: If a student violates the principles of fairness and impartiality in the exam and obtains or attempts to obtain exam answers or exam scores through improper means, the relevant disciplinary measures shall refer to Article 22 of the "Regulations on the Handling of Student Violations at Nanjing Forestry University (Revised)".
Article 21: If a student commits serious cheating or other behaviors in the examination room, the relevant punishment measures shall refer to Article 23 of the "Regulations on the Handling of Student Violations at Nanjing Forestry University (Revised)".
Article 22: Those who violate academic norms shall be punished as follows:
(1) Those who engage in academic misconduct such as plagiarism, tampering, or forgery in academic dissertations or publicly published research results, and whose circumstances are serious, or those who write or buy or sell papers on behalf of others, shall be subject to expulsion from their academic status.
(2) Those who engage in academic misconduct such as plagiarism, or falsification of research results, experimental data, or calculation results, but have not reached the level of expulsion from school, shall be given a serious warning or above depending on the severity of the situation.
(3) Those who forge academic experience, academic achievements, expert appraisal, certificates, and other academic ability proof materials, but do not reach the level of expulsion from school, shall be given a serious warning or above depending on the severity of the situation.
Chapter 4 Punishment and Termination Procedure
Article 1: Disciplinary sanctions and termination of sanctions shall be imposed on international students. The college and relevant units where the international students reside shall each fulfill their respective responsibilities and coordinate their work, promptly investigate and handle disciplinary violations committed by the international students.
Article 2 Disciplinary Procedure:
(1) After discovering that international students are suspected of violating discipline or receiving relevant reports about violation, relevant units and colleges shall promptly investigate and collect evidence, and contact the College of International Education (hereinafter referred to as CIE) to cooperate in relevant investigation and collect disciplinary materials;
(2) Before making a disciplinary decision against international students, they should be informed of the facts, reasons, and basis for making the decision, and should be informed of their right to make statements and defend themselves, and l their statements and defenses shall be heard;
(3) The international student counselor shall fill out the registration form for the punishment of international students and clearly state the facts of the student's violation of discipline;
(4) The punishment facts shall be signed by the international student in person;
(5) The academic meeting of ICE discusses what disciplinary measures should be given to international students who violate discipline;
(6) For international students who are subject to the following disciplinary measures during their stay on campus probation, a disciplinary decision letter shall be issued through discussion and approval by the Academic Affairs Meeting of the College of International Education ; The disciplinary action of expelling students should undergo a legal review in advance. After being discussed and approved by the principal's office meeting, the school shall issue a disciplinary decision and report it to the exit and entry department;
(7) After the issuance of disciplinary action for international students, the disciplinary action decision letter for international students should be delivered to the student within 5 days. If the student refuses to sign for it, it can be delivered by way of retention; Those who have left school can be delivered by mail; If it is difficult to contact, it can be delivered through announcement methods such as the school website and news media. The announcement period is 10 days, counting from the date of the announcement.
Article 3: Disciplinary actions shall be taken against international students, and the school shall issue a disciplinary decision. The disciplinary decision shall include the following contents:
(1) Basic information about international students.
(2) The facts and evidence of the disciplinary action taken.
(3) The type, basis, and deadline of punishment.
(4) The channels and deadlines for appeal.
(5) Other necessary content.
Article 4: If international students have objections to the disciplinary decision, they may file an appeal with the College of International Education within 10 days of receiving the disciplinary decision notice. International students' appeals shall be handled in accordance with the relevant regulations of the school regarding appeals.
Article 5: International students who are expelled from their academic status shall complete the procedures for leaving the school, canceling their residence permit, and applying for a zero visa within 10 days from the date of receiving the school's disciplinary decision, and shall be limited to leaving the country within the validity period of the zero visa; If the deadline is not met, the College of International Education shall be responsible for handling the matter; Those who refuse to leave the school will be dealt with the way dealing with the disturbance of school order by personnel outside the school
Article 6 Explanation of the disciplinary period and the procedure for terminating the disciplinary action:
In addition to being expelled from school, the punishment given to students should generally be within a period of 6 to 12 months, calculated from the date of the school's issuance. After the expiration of the disciplinary period, students shall apply for termination of the disciplinary action according to the procedures. The termination of student sanctions shall be handled in a centralized manner on a regular basis, and the date of termination shall be calculated based on the expiration date of the sanctions.
The procedure for lifting the punishment: Students can fill out the application form for lifting the punishment, the counselor signs the opinion, the Student Work Conference of the College of International Education deliberates, the Academic Affairs Conference of the College of International Education reviews, and report to the leader in charge of the school for decision, and the punishment can be lifted.
Article 7: The decision on punishment or the decision to terminate the punishment shall take effect from the date of its making. The punishment and termination materials for international students should be truthfully and completely included in the school's documents and personal files.
Article 8: After the termination of the punishment, international students shall receive recognition, rewards, subsidies, and other rights and interests, and shall no longer be affected by the original punishment.
Article 9: If a person has already received disciplinary action during the study period and is subject to further disciplinary action, the disciplinary level shall be accumulated. If the circumstances are serious, the student will be expelled.
Article 10: Disciplinary actions against those who violate Chinese laws and regulations and are punished by judicial authorities shall be based on the legal documents of the judicial authorities.
Article 11: During the punishment process and after the termination of the punishment, the international student counselor shall pay attention to the situation of the international student, conduct educational management and heart-to-heart talks to assist the international student, and ensure that the international student has a deep understanding of past violations and draws lessons from them, so as not to commit violations again. The College of International Education shall establish records for students who engage in related violations of rules and regulations, and pay attention to their development.
Chapter 5 Supplementary Provisions
Article 1: The "above" or "below" punishment referred to in these regulations includes the same level of punishment.
Article 2: For illegal, irregular, and disciplinary behaviors not listed in this regulation, corresponding punishments may be given based on the severity of the situation and the degree of impact, in accordance with the relevant rules and regulations of the school.
Article 3: These regulations shall be interpreted by the College of International Education of Nanjing Forestry University , which is responsible for its interpretation and supplementation. It is written in both Chinese and English. If there is any ambiguity, the Chinese version shall prevail. This regulation shall come into effect from the date of promulgation.
